IrvingLehman(January 28, 1876 – September22, 1945) was an American lawyer and politician fromNew York. He was Chief Judge of theNew York Court of Appealsfrom1940 until his death in 1945.[1]

Biography

Hewas born on January 28, 1876, inNew York CitytoMayer Lehman(d. 1897) and Babette Newgass andraisedJewish. Future New York State governor and United StatesSenatorHerbert H. Lehmanwashis brother. He graduated with an A.B. fromColumbia Collegein1896 and anLL.B.fromColumbia University LawSchoolin 1898.[1][2]

Hewas a justice of theNew York Supreme Courtfrom1909 to 1923, elected in 1908 on the Democratic ticket, and re-elected in 1922on the Democratic and Republican tickets.[3]

In1923, he waselected on the Democratic and Republican tickets to a 14-year term on theNew York Court of Appeals,and re-elected in1937. In1939, he was electedChief Judge of the Court of Appeals on theDemocratic,RepublicanandAmerican Labortickets,and remained on the bench until his death in office.[1]

In1942 the New York Court of Appeals affirmed the convictions of thenotoriousLouis Buchalterandhis two associatesEmanuel WeissandLouis Caponeunder a sharply divided decision of thejudges, who filed four opinions. The death sentences were upheld by a vote of4–3. (People v. Buchalter, 289 N.Y. 181) However, Judge Lehman, who was alsoaffirming the conviction of the three, expressed some doubts in the verdict andstated that the errors and defects in the case were in fact numerous.[4]In 1943theUnited States SupremeCourtgranted Buchalter\'s petition to review the case and in afull opinion affirmed the conviction, 7–0, with two justices abstaining. (319U.S. 427 (1943)) Finally, Judge Lehman signed ashow cause orderin 1944 because the counsel for the triohad appeared before GovernorThomas E. Deweyin a clemency plea, and Lehman eventuallydelayed the execution of the condemned men.[5]Evenso, the clemency plea was denied by Governor Dewey. On March 4, 1944, EmanuelWeiss thanked Chief Judge Lehman in his final words before being electrocutedinSing Sing.

Personallife

OnJune 26, 1901, he married Sissie Straus, the daughter ofNathan Straus,[1]Americanmerchant and philanthropist who co-owned two of New York City\'s biggestdepartment stores,R.H. Macy & CompanyandAbraham & Straus.[6]Thecouple was childless.[7]

Lehmandied of a heart ailment on September 22, 1945, at his home on Ridge StreetinPort Chester, New York.[1]Serviceswere held atTemple Emanu ElinManhattan.[7]He wasburied at theCypress Hills Cemetery.
